शिमला। माकपा नेता राकेश सिंघा ने प्रदेश हाईकोर्ट के ओरल निर्देशों का हवाल देते हुए डीसी किन्नौर को चिटठी लिखी है कि वो इन आदेशों का पालन करवाएं। सिंघा ने अपनी चिटठी में दावा किया है हाईकोर्ट ने सरकार व कंपनी को ओरल निर्देश दिए है कि वो कडछम वांगतू के 700 से एक हजार तक के मजदूरों को उनके आवासों को जाने से न रोके।सिंघा ने इस चिटठी में कहा है कि वो खुद अदालत में थे और अब मामले की सुनवाई 31 मार्च को रखी गई है।
सिंघा ने ये चिटठी हाईकोर्ट के ओरल निर्देशों के बाद तुरंत डीसी किन्नौर को भेज दी।

Subject: Civil writ petition title JP Workers Union Karcham Wangtoo & Baspa-II versus State of Himachal Pradesh and others.
Sir,
The Hon’ble High Court took up the civil writ petition titled Workers Union Karcham Wangtoo & Baspa-II versus State of Himachal Pradesh and others in which the petitioner union had prayed for interim relief apart from other reliefs, today i.e. 26th March, 2015.
The Ld. Advocate General appeared on behalf of the state while the respondent No.5 the JP Company was represented by Advocate Rahul Mahajan. The Hon’ble Court was pleased to make an oral observation on which it directed both the state as well as respondent Company to, not to prevent the petitioner workmen from in entering in to the shelter accommodation (place of their residence). The matter would come before the Hon’ble Court to be taken up on Tuesday 31st 2015. I was present in the Hon’ble Court when this observation and oral direction was made.
Since 18th March 2015 when you had made in order of section 144 Cr. P.C in an around the work sites of the JP hydro power venture generating electricity from Baspa-II and Karcham Wangtoo hydel projects, I have made four different application to you in your capacity of District Magistrate. The first application was made on 20th March,2015 which was delivered to you through wireless message through Police Chowki Tapri, the second was made the following day that is 21st March,2015 in which I had requested you to issues a corrigendum in respect to the order made by you under section 144 Cr. P.C on 18th March,2015 as the order was being misused by the JP management who were assisted by the police to prevent the workmen from exercising their fundamental right of life and liberty as enshrined in the constitution of India as the workmen were unable to take shelter and food from the accommodation allotted to them. As no corrigendum was issued by you, I made another application to you on 23rd, March 2015 in which I had requested you to arrange for a videographer who would video graph the entry of the workmen in the shelter accomodation at Kagsthal in a peaceful manner with out disobeying the order made by you on 18th March, 2015. It is unfortunate that you in the capacity of Magistrate did not heed to my request and continued to allow the pains of the workers to increase. On 23rd March 2015, I had made an another application to you in which I had made a request to direct the JP company to stop all the recruitments as it violated the procedure laid down by the law as section 33 of Industrial Dispute Act 1947 states very clearly that it is only the Court in which the matter is being adjudicated can go into the merit of granting or not granting permission for recruitment of new workmen. As per my information the JP company without adhering to the laid down principle’s of law, continuous to recruit new workmen. Not only because of the Industrial Dispute, the law demands that these workers need to be registered with the Labour deptt. as an evidence to ensure their presence incase some unfortunate mishap happens to take place.
Please do the needful, and I once again request you to ensure that the intentions of the Hon’ble High Court are not defeated and the workers are allowed to go into their shelter accommodation in Kupa, Kilba, Sholtu, Kagsthal and Sherpa colony where the workers are residing.
